Statute Litigation Costs/Substantive Rights

An injury prior to the effective date of litigation costs under O.C.G.A. § 34-9-108(b) were not allowed because the Court of Appeals concluded that the statute provision created a substantive right. Effective date of the statute was July 1, 2001.
